These Terms of Service ("Terms") govern your use of the Ornamart mobile application and website (collectively, the "Platform"). By registering or using the Platform, you agree to be bound by these Terms.
1. About Ornamart
Ornamart is an online marketplace that connects buyers ("Customers") and sellers ("Sellers") of jewellery and ornaments. Ornamart acts as an intermediary platform and is not the manufacturer or direct seller of any product listed on the Platform, unless explicitly stated.
2. Eligibility
- You must be at least 18 years of age to use the Platform.
- By using the Platform, you represent that you have the legal capacity to enter into a binding agreement.
- Sellers must be individuals or businesses legally permitted to sell goods in India and must complete the required KYC verification.
3. Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate and up-to-date information during registration.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Seller Responsibilities
Sellers agree to:
- List only genuine products that match the photos, descriptions, and specifications provided.
- Fulfil orders promptly and within the stated processing time.
- Package products securely to prevent damage during transit.
- Comply with all applicable laws, including GST regulations.
- Not list counterfeit, prohibited, or restricted goods.
- Maintain accurate stock levels and remove out-of-stock listings promptly.
Sellers acknowledge that Ornamart may remove listings, suspend accounts, or withhold payouts if these responsibilities are not met.
5. Customer Responsibilities
Customers agree to:
- Provide accurate delivery addresses and contact information.
- Grant location permission when using the "Use My Location" feature (optional). Location data is used solely to auto-fill address fields and improve delivery accuracy.
- Make payments in good faith and not initiate fraudulent disputes.
- Record an unboxing video when receiving orders (required to raise damage or wrong-item complaints).
- Raise complaints within 2 days of delivery.
6. Orders and Payments
- All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
- Payments are processed securely by Razorpay. Ornamart does not store payment credentials.
- An order is confirmed only after successful payment.
- Ornamart reserves the right to cancel orders in cases of pricing errors, stock unavailability, or suspected fraud.
7. Shipping
- Shipping is handled through Delhivery and other logistics partners.
- Estimated delivery times are indicative and not guaranteed.
- Ornamart is not liable for delays caused by logistics partners, natural events, or circumstances beyond our control.
8. Returns, Refunds, and Exchanges

In summary:
- Complaints must be raised within 2 days of delivery.
- An unboxing video is required to support any damage or wrong-item claim.
- Returns are accepted only for: damaged items, wrong items, or items materially not matching the listing.
- No returns for change of mind, size/colour preference, or personal dislike.
9. Dispute Resolution
- Disputes between buyers and sellers are mediated by Ornamart.
- Ornamart's decision on disputes is final and binding on both parties.
- Ornamart reserves the right to issue refunds, withhold payouts, or take other corrective action as deemed appropriate.
10. Intellectual Property
- All content on the Platform (logos, design, text, software) is owned by or licensed to Ornamart.
- Sellers retain ownership of their product photos and content but grant Ornamart a non-exclusive licence to display and promote that content on the Platform.
- You may not copy, reproduce, or distribute Platform content without written permission.
11. Prohibited Conduct
You must not:
- Use the Platform for any unlawful purpose.
- Post false, misleading, or fraudulent listings or reviews.
- Attempt to circumvent the Platform to conduct transactions directly with buyers/sellers.
- Interfere with the Platform's technical systems or security.
- Harass, abuse, or harm other users.
12. Limitation of Liability
- Ornamart is a marketplace platform and is not liable for the quality, safety, or legality of products listed by sellers.
- To the maximum extent permitted by law, Ornamart's total liability for any claim arising from use of the Platform is limited to the value of the transaction in dispute.
- Ornamart is not liable for indirect, incidental, or consequential damages.
13. Indemnification
You agree to indemnify and hold Ornamart harmless from any claims, losses, or damages (including legal fees) arising from your violation of these Terms or your use of the Platform.
14. Termination
- You may delete your account at any time via Settings → Delete Account or at ornamart.in/delete-account.
- Ornamart may suspend or terminate your account for violation of these Terms, fraudulent activity, or any other reason at our discretion, with or without notice.
- Upon termination, pending payouts (for sellers) will be processed after any applicable hold period and deductions.
15. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
16. Changes to These Terms
We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms. We will notify users of material changes via the app or email.
